McIvor is a law professor, and this is basically a run down of what the current legal situation regarding Indigenous rights in Canada, and why it's stupid. The "how to fix it" part is basically "throw out the doctrine of discovery, for fuck's sake!" It's part an effort at education, and part a scream of frustration that the Crown is acting in such bad faith so very often and that it's wasting everyone's time and money when they could just not do that. Anyway, I learned a fair bit about the duty to consult and conflict of interest. Well worth a read if this is the kind of thing in which you are interested. It's all very plainly explained, and free of extremely long words and references to German philosophers (I'm looking at you Reconciliation Without Reconciliation?).
